Public offer contract
This contract is between the Online Storehttps://www.kilinskirestaurant.com, hereinafter the "Seller" and the user of the services of the Kilinski online store, hereinafter the "Buyer", is an assignment contract for the order, purchase and delivery of food and defines the basic conditions for ordering, purchasing and delivering food through the online store at the linkhttps://www.kilinskirestaurant.com. The buyer, acting for the purpose of purchasing food, accepts the terms of this agreement for the purchase and sale of food (hereinafter - the Agreement) on the following terms.
1. Definition of terms
1.1. Public offer (hereinafter - the "Offer") - the public offer of the Seller, addressed to an unspecified circle of persons, to conclude a contract for the purchase and sale of food remotely (hereinafter - the "Agreement") with the Seller on the terms and conditions contained in this Offer, including all Appendices.
1.2. Order - the decision of the Buyer to order food and its delivery, made in the online store and / or an order for the purchase and delivery of food.
2. Terms
2.1. According to Article 642 of the Civil Code of Ukraine, the complete and unconditional acceptance of the terms of this offer (offer), which confirms the conclusion of the Agreement for the purchase and sale of food on the terms proposed below, is the fact of execution and confirmation of the order.
2.3. By completing the Order, the Buyer confirms agreement and unconditional acceptance of the terms of this proposal (offer).
2.4. By concluding the Agreement (that is, by accepting the terms of the actual Offer (Offered Opportunities) by placing an Order), the Buyer confirms the following:
a) The buyer is fully and completely acquainted with and agrees with the terms of this offer (offer);
b) he gives permission for the collection, processing and transfer of personal data under the conditions specified below in the Clause on the collection, processing and transfer of personal data, the permission for the processing of personal data is valid for the entire term of the Agreement, as well as for an unlimited period after its expiration. In addition, by concluding the Agreement, the Buyer confirms that he has been notified (without additional notification) of the rights established by the Law of Ukraine "On the Protection of Personal Data", the purposes of data collection, as well as the fact that his personal data is transferred to the Seller for the purpose of being able to fulfill the conditions of this Agreement, the possibility of mutual settlements, as well as to receive invoices, acts and other documents. The Buyer also agrees that the Seller has the right to provide access and transfer his personal data to third parties without any additional notifications from the Buyer, without changing the purpose of personal data processing. The extent of the Buyer's rights as a subject of personal data in accordance with the Law of Ukraine "On the Protection of Personal Data" is known and understood by him.
3. The price of food
3.1. The price for each item of food is indicated in the Kilinski online store at the website linkhttps://www.kilinskirestaurant.com.
3.2. The seller has the right to unilaterally change the price of any item of food.
3.3. In case of a change in the price of the ordered food, the Seller undertakes to inform the Buyer about the change in the price of the food.
3.4. The Buyer has the right to confirm or cancel the Order for the purchase of food, if the price is changed by the Seller after placing the Order.
3.5. The Seller cannot change the price of food paid for by the Buyer.

3.7. The Buyer's obligations to pay for food are considered fulfilled from the moment the funds are received by the Seller.

4.5. When placing an order through the Operator (clause 4.1. of this Offer), the Buyer undertakes to provide the information specified in clause 4.2. of this Offer.
4.6. 5.5. The Buyer or the Buyer's Representative, while taking the food, confirms with his consent that he has no complaints about the amount of food, appearance and completeness of the food.
6. Return or exchange of food
6.1. The Buyer does not have the right to refuse food of appropriate quality, which has individually defined properties, if the specified food can be used exclusively by the Consumer who purchased it (including non-standard, at the Buyer's request, sizes, etc.). 6.2. 7.4. The Seller or the Buyer shall be released from responsibility for full or partial non-fulfillment of their obligations, if the non-fulfillment is the result of force majeure circumstances such as: war or hostilities, earthquake, flood, fire and other natural disasters that occurred regardless of the will of the Seller and / or the Buyer after concluding this contract. A Party that cannot fulfill its obligations shall immediately notify the other Party thereof.
